Notice in accordance with Art. 13 of Legislative Decree no. 196 of 30 June 2003, as amended.

 

In accordance with and to all effects of Art. 13 of Legislative Decree no. 196 of 30 June 2003, as amended (Italian Personal Data Protection Code; hereinafter “Code”), it is the duty of the Associazione “Ente per le Arti Applicate alla Moda ed al Costume” (hereinafter also denominated “Polimoda”), headquartered in Via Pisana no. 77 – 50143 Florence, as Data Controller, to provide certain information concerning its use of your personal data as collected and processed to you as data subject.

Your personal data, including data defined as “sensitive,” will be processed when strictly necessary to meet the requirements of the law and/or to provide you with the services you request of Polimoda; said data will be processed by manual, electronic, and/or telematic means according to logic strictly correlated with the purposes for which the data is collected, and may entail any or all of the operations described in Article 4 § 1, letter a), of the Code. In all cases, any and all data supplied by you will be processed in full observance of the applicable laws and of the duties of confidentiality set by said laws, and will be processed only by authorized subjects and applying all the data security measures prescribed by the privacy laws in force at any moment.

In detail, your data may be processed, as part of Polimoda’s normal activity, for purposes inherent to and necessary for meeting the obligations set by applicable national and European Union laws and regulations, solely for:

 

a) purposes inherent to communication of information relating to the courses and the other activities carried on by Polimoda and/or to your application for admission to the same courses and activities, your consequent attendance, and all other activities relating to completion of the training activities;

 

b) purposes inherent to dispatch of informative/promotional material concerning the Polimoda courses and the other activities carried on by Polimoda and by its subsidiary Polimoda Consulting S.r.l. (such as newsletters, brochures, depliants, posters, information CDs, and other, similar material) by e-mail and/or ordinary mail or fax.

Additionally, again in full observance of the minimum security measures required by law, your data may be communicated to law enforcement authorities and to other public and private subjects in the measure required for meeting the obligations set by law, which may be of tax-related, administrative, financial, or similar nature.

Let us remind you that communicating your personal data to Polimoda is compulsory to permit Polimoda to meet the obligations set by national and European Union laws and regulations, while:

 

(a) communication is optional for the purposes set forth at point a) above; nevertheless, should you refuse to provide your data for the purposes in question, Polimoda will not be able to manage all the operations inherent to your requests for information concerning the courses and the other activities carried on by Polimoda and/or your enrolment in said courses/activities and consequent attendance and, therefore, to provide you with the information you may request and/or proceed with enrolling you in the courses and consequently managing your attendance;

 

(b) communication is optional for the purposes set forth at point b) above; nevertheless, should you refuse to provide your data for the purposes in question, Polimoda will not be able to manage all the operations inherent to and deriving from your requests to receive information/promotional material from Polimoda and Polimoda Consulting S.r.l. and, therefore, to send you said material.

 

In no case may your data be published, but all your data, including sensitive data when strictly required by the law and/or for providing the services you request of us, may be transferred and/or communicated:

 

for the purposes set forth at point a) above, to the subsidiary company Polimoda Consulting S.r.l. and/or to Lylix, Post Office Box 372, Chicora, 16025 Pennsylvania (USA), which on our behalf performs technical/organizational tasks essential for providing the services requested, and/or – only in the case you request admission to the courses and consequently attend same and participate in the training activities – to public and private bodies (for example, the local health agency, hospitals, private clinics, banks, insurance companies); for the purposes set forth at point b) above, to the subsidiary company Polimoda Consulting s.r.l. as well as to the companies denominated Lylix, Post Office Box 372, Chicora, 16025 Pennsylvania (USA) and Contactlab by Tomato Interactive S.r.l., Via Natale Battaglia no. 10, Milan, the latter two of which, on our behalf, perform technical/organizational tasks essential for providing the services requested.

 

Article 7 of the Code grants the data subject a number of specific rights, including the right:

 

to obtain confirmation as to whether or not personal data concerning him/her exist and communication of such data in intelligible form; to be informed of the source of the personal data, of the purposes for which and the methods by which the data are processed, of the logic applied to processing if the latter is carried out with the help of electronic means, of the identification data concerning data controller and the subjects to whom or which the personal data may be communicated;  to obtain updating, rectification, or integration of the data and erasure, anonymization, or blocking of data that have been processed unlawfully; to object, in whole or in part, on legitimate grounds, to processing of personal data concerning him/her.
